1. Description of Services

AI Powered Gyms provides AI-powered calling agents that automate outbound calls for gyms, including lead follow-up, member retention, and membership reactivation. Our services include voice cloning technology, CRM integration, and performance analytics.

2. Account Requirements

• You must be at least 18 years old to use our services
• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the security of your account credentials
• You must have the authority to bind your business to these Terms

3. Acceptable Use

You agree to use our services only for lawful purposes. You may not:

• Use our services for any illegal activities, including violations of telemarketing laws
• Provide false or misleading information during calls
• Use our voice cloning technology without proper consent
• Attempt to reverse engineer or copy our technology
• Interfere with or disrupt our services

4. Voice Cloning Consent

By providing voice recordings for cloning, you represent that you have obtained all necessary consents from the individual whose voice is being cloned. You are solely responsible for ensuring compliance with applicable laws regarding voice cloning and synthetic media.

5. Payment Terms

Subscription fees are billed monthly in advance. Setup fees and per-call charges may apply based on your plan. All fees are non-refundable except as required by law or as specified in our guarantee.

6. Performance Guarantee

We offer a 30-day money-back guarantee if you are not satisfied with our services. After the guarantee period, cancellation will take effect at the end of your current billing cycle.

7. Data Ownership

You retain ownership of all data you provide to us. You grant us a limited license to use your data solely for providing and improving our services. We do not sell your data to third parties.

8. Limitation of Liability

To the maximum extent permitted by law, AI Powered Gyms shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim.

9. Termination

Either party may terminate this agreement with 30 days written notice. We may suspend or terminate your account immediately if you violate these Terms or for non-payment.

10. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through our service. Continued use of our services after changes constitutes acceptance of the new Terms.

11. Governing Law

These Terms are governed by the laws of the State of Minnesota without regard to conflict of law principles. Any disputes shall be resolved in the courts of Hennepin County, Minnesota.
